OIC maintains a PAIA Manual prepared under section 51 of PAIA, read with the Protection of Personal Information Act 4 of 2013 (“POPIA”). Section 51 requires the head of a private body to make the prescribed manual available, including information concerning the categories of records held and the procedure for requesting access.
1. Section 51 PAIA Manual and Access to Records
10.1 OIC is a private body for purposes of the Promotion
of Access to Information Act 2 of 2000 (“PAIA”).
10.2 OIC maintains a PAIA Manual prepared under section 51
of PAIA, read with the Protection of Personal Information Act 4 of 2013
(“POPIA”). Section 51 requires the head of a private body to make the
prescribed manual available, including information concerning the categories of
records held and the procedure for requesting access.
10.3 OIC’s PAIA Manual is available:
- at
OIC’s principal place of business;
- on
OIC’s website, where published; or
- electronically
upon written request to OIC’s Information Officer.
10.4 Requests for access to records must be submitted on the
prescribed PAIA form and must contain sufficient information to:
- identify
the requester;
- identify
the record requested;
- specify
the preferred form of access;
- identify
the right the requester seeks to exercise or protect; and
- explain
why the requested record is required for exercising or protecting that
right.
10.5 Access is not automatic. OIC may grant or refuse access
in accordance with PAIA, POPIA and any other applicable law, including
provisions protecting personal information, legally privileged communications,
confidential commercial information, trade secrets and third-party rights.
10.6 Any prescribed request or access fee must be paid where
applicable before the request is processed or access is provided.

10.8 OIC’s Information Officer is responsible for
facilitating PAIA requests and supporting compliance with POPIA, subject to
registration and the applicable statutory requirements administered by the
Information Regulator.
